Terms and Conditions

• 1. General

  1.1 These Business Terms and Conditions apply to the purchase of contracts concluded through the website of www.pivotscipub.com and all subdomains (hereinafter "Website") or through related e-mail communication, and to all related services provided by the Pivot Science Publications Corporation, 600 - 1285 W Broadway, Vancouver, Canada BC V6H 3X8 (hereinafter referred to as "Pivot").

  1.2 Any user of the website or buyer of services shall be referred to as "Customer" throughout these Terms and Conditions.

  1.3 Any business terms by the Customer which diverge from these Terms and Conditions shall not apply, unless expressly confirmed by Pivot in written form.

• 2. Copyright of This Website

  This Website is owned and operated by Pivot and is protected by international copyright and trademark laws. Any person may not modify, copy, reproduce, republish or distribute any part or in whole, in any way, including code and software, for personal, commercial or non-commercial use.

• 3. Copyright of Submission and Publication

  3.1 Your manuscript is submitted for consideration on the understanding that it has not been published or submitted elsewhere. Exceptions to this rule are papers containing material presented at conferences; however, you should inform us if this is the case. For papers with multiple authors, please also confirm that all authors are familiar with the contents of the manuscript, and agree with the submission to Pivot. Pivot reserves the right to contact all authors in order to confirm this in case of any doubt. Institutional email addresses of authors should be provided where possible.
  

  3.2 If any manuscript contains material reproduced from other publications, please provide written proof that you have obtained the necessary copyright permission.

  3.3 Your article ("Article"), if accepted for publication, will be an Open Access article distributed under the Creative Commons Attribution 4.0 International License (CC BY 4.0).

• 4. Service of Pivot

  Pivot provides science publication and editorial services, which can be ordered by the Customer via the Website.

• 5. Ordering and Purchasing of Services from Pivot

  5.1 Registration: To order a publication service through the Website, the Customer must first register with the Website. The requirements for registering with the Website are that the Customer is of adult age and has full legal capacity.
  

  5.2 Ordering: The Customer orders contracting publication and editorial services from Pivot the moment she/he submits an original Article for evaluation through peer review and possible publication by Pivot.

  5.3 Agreement to copyright terms: By submitting an original Article to Pivot, the Customer agrees to support Open Access publishing, which allows unlimited access to his/her published paper.

  5.4 Agreement to publication fees: By submitting an original Article to Pivot, the Customer agrees to the publication fees if the Pivot journal charges Article Processing Charges (APCs) and is bound to pay the APCs after acceptance of the paper for publication.

  5.5 Replacement: We do not encourage replacement after the manuscript is assigned to reviewers and editors. Please check the manuscript carefully before submitting it to us.

  5.6 Cancellation by Customer: The Customer is allowed to withdraw her/his article and cancel the declared intention to conclude the contract any time before the article is officially accepted for publication. Once accepted, however, it may no longer be withdrawn by the Customer. Any benefits or interests received by the Customer up to the cancellation must be restituted to Pivot.

  5.7 Cancellation by Pivot: Pivot may reject the Article anytime without specifying any reason thereby cancelling the conclusion of the contract. After cancellation by Pivot, both parties are freed from any previous commitments of these Terms and Conditions.

  5.8 Refunding: If the Customer wishes to receive a refund after cancellation, all refund-related costs, such as transfer fee, will be deducted from the refund amount.

• 6. Pricing and Payment

  6.1 Prices of Pivot services are stated at the page: www.pivotscipub.com/fees. The applicable price for the publication service regarding an accepted Article is based on the date of the original submission of the Article to Pivot.
  

  6.2 Invoices are sent by e-mail to the payment corresponding person indicated by the Customer soon after official acceptance of an Article for publication.

  6.3 Payments to Pivot are due within 5 working days of sending the invoice to the Customer. 

• 7. Change of Terms and Conditions

  7.1 Pivot reserves the right to modify or amend these Terms and Conditions at any time by posting changes to this page of the Website with or without prior notice. Please check these Terms and Conditions periodically for any changes. The changes will only affect your use of the services after the effective date of the change unless we clearly express otherwise. Your continued use of any Service following the posting of any changes will be held to mean that you have accepted and agreed to the changes.

  7.2 If any provisions of the Terms and Conditions should be found invalid, this shall not affect the validity of the remaining provisions. In any such case, the contracting parties shall negotiate on the invalid clause to substitute by a valid arrangement as close as possible to the original provision.
  

• 8. Governing Law

  8.1 Vancouver, BC, Canada, shall be the place of jurisdiction for all legal disputes arising of these Terms and Conditions, even if the Customer has her/his domicile outside of the Canada.

  8.2 Law of British Columbia, Canada applicable at the place of jurisdiction of Pivot shall apply exclusively.
